1. Acceptance of Terms

By accessing or using Kalia Marketing ("the Service"), operated by Kalia Technologies SAS ("Kalia"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

2. Description of Service

Kalia Marketing is a social media and advertising management platform that enables businesses to manage their presence on Meta platforms (Facebook, Instagram, Meta Ads). The Service allows users to publish content, manage engagement, and run advertising campaigns through Meta's APIs.

3. Account Registration

To use the Service, you must create an account through our authentication provider (Clerk). You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information during registration.

4. Meta Platform Integration

The Service integrates with Meta Platforms through their official APIs. By connecting your Meta assets (Facebook Pages, Instagram accounts, Ad accounts), you authorize Kalia to access and manage these assets on your behalf within the scope of permissions you grant. You represent that you have the authority to connect these assets and that doing so does not violate any agreements with Meta or third parties.

5. User Obligations

• Comply with all applicable laws and regulations, including advertising laws.
• Comply with Meta's Terms of Service, Advertising Policies, and Community Standards when publishing content or running ads through our platform.
• Not use the Service for any unlawful purpose, including spam, misleading advertising, or content that violates third-party rights.
• Ensure that all content published through the Service is owned by you or properly licensed.
• Maintain the security of your account credentials and connected tokens.

6. Content & Advertising

You retain ownership of all content you create and publish through the Service. Kalia does not claim any intellectual property rights over your content. You are solely responsible for the content you publish and the advertising campaigns you create, including compliance with Meta's advertising policies and applicable advertising laws.

7. AI-Generated Content

The Service may offer AI-powered content generation features. AI-generated content is provided as suggestions only. You are responsible for reviewing, editing, and approving all content before publication. Kalia is not liable for any claims arising from AI-generated content that you choose to publish.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service depends on third-party APIs (Meta Graph API, Meta Marketing API) that may experience downtime or changes outside our control.

9. Limitation of Liability

To the maximum extent permitted by law, Kalia shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to: loss of revenue from advertising campaigns, content publishing failures, or account suspensions by Meta.

10. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access if you violate these Terms. Upon termination, we will delete your data in accordance with our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the Argentine Republic. Any disputes shall be resolved in the courts of the Autonomous City of Buenos Aires, Argentina.
